Sloop Diana - 1799

This Indenture, made the twelfth Day of April in the thirty eighth year of the Reign of our Sovereign Lord George the Third by the Grace of God of Great Britain, France and Ireland, King, Defender of the Faith and so forth and in the year of our Lord one thousand seven hundred and ninety nine.
Between The Reverend Henry Wilder of Purley Hall, in the County of Berks, Clerk, Doctor of Law, and Martin Maddison of the Town and County of the Town of Southampton, Banker, surviving Assignees of the Estate and Effects of Robert Stares, late of the Parish of Bishops Waltham, Miller, a Bankrupt deceased of the one part and William Waller of Bursledon in the said County of Southampton, Mariner of the other part.
Whereas the said Robert Stares at the time he became Bankrupt was owner of the Moiety or one half part of the Ship or vessel called the Diana and the same had been duly registered according to the Act of Parliament in that case made and provided a Copy of the Certificate of the Registry whereof is in the following Words and Figures that is to say N°. 167. In pursuance of an Act passed in the Twenty sixth year of the Reign of King George the third instituted an Act for the further Increase and Encouragement of Shipping and Navigation.

Robert Stares of Botley in the County of Southampton Merchant and George Parsons of Bursledon in the County, Ship Builder having taken and subscribed the Oath required by this Act and having sworn that they are the sole owners of the Ship or Vessel called the Diana of Southampton, whereof William Waller is at present Master and that the said Ship or Vessel was built at Bursledon in the Port of Southampton in this present year one thousand seven hundred and eighty seven and completed and launched on the thirtieth Day of October last as appears by Certificate under the hand of George Parsons, Shipwright and Builder of the said Vessel dated the eighth instant and Nicholas Robinson, Tide Surveyor, having certified to us that the said Ship or Vessel is British Built, has one Deck and one Mast, that her length from the forepart of the Main Stem, to the After part of the Stern Post aloft is Fifty six feet Two inches, her breadth at the broadest point above the Main Wales, Seventeen Feet three inches. Her height in the Hold, Nine Feet six inches, and admeasures Sixty three Tons, that she is a square sterned sloop, has neither Gallery nor figure Head and the said subscribing owners having consented and agreed to the above Description and Admeasurement and having caused sufficient Security to be given as is required by the said Act.

The said Sloop Diana has been duly registered at the Port of Southampton – Given under our Hands and Seals of Office at the Custom House in the said Port of Southampton, this fourteenth Day of November in the Year, one thousand seven hundred and eighty seven.
Wm. Smith,………. And Whereas the said Henry Wilder and Martin Maddison have agreed with the said William Waller to sell him the aforesaid Moiety or one half part of the aforesaid Vessel and all their Estate and Interest thereon for the Sum o Two hundred and sixty two Pounds and Ten Shillings.

Now this Indenture Witnesseth that in pursuance of the said Contract and in consideration of the sum of Two hundred and sixty two pounds and ten shillings of lawful Money of Great Britain to them the said Henry Wilder and Martin Maddison in hand paid by the said William Waller. The receipt whereof they the said Henry Wilder and Martin Maddison do herby respectively acknowledge and thereof and of, and from every part thereof do respectively acquit release and discharge the said William Waller his executors and Administrators and every of them forever by these presents.

They the said Henry Wilder and Martin Maddison, have and each of them hath bargained sold and delivered and by these presents do and each of them doth bargain sell and deliver unto the said William Waller, The one full moiety or half part of. All that the aforesaid Ship or Vessel the Diana. Together with one full moiety or half part of all Masts, Yards, Boats, Oars, Sails, Anchor Cables, Ropes, Cords, Standing and Rigging, Rigging Tackle and Furniture to the said ship or Vessel belonging or in any wise appertaining.

And all the Right Title Property Claim and Interest of them the said Henry Wilder and Martin Maddison of and in and to the said Moiety or half part of the said Ship or Vessel and premises so hereby granted bargained sold and delivered as Aforesaid To Have and To hold the said Moiety or half part of the said Ship or Vessel and all other the premises herby bargained sold and delivered with the appurtenances unto the said William Waller, his Executors, Administrators and Assigns as his and their own proper Goods and Chattels, and to his and their own proper Use and Benefit from henceforth for ever. And the said Henry Wilder and Martin Maddison do hereby for themselves severally covenant grant and agree to and with the said William Waller his Executors, Administrators and Assigns that they the said Henry Wilder and Martin Maddison, or either of them have not, nor hath done or committed any Act Matter or Thing whatsoever to change or incumber the above mentioned Ship or Vessel. In Witness whereof the said Parties to these presents have hereunto subscribed and set their hands and seals the Day and Year first above written.
